INTRODUCTION

The Supreme Court has ruled that certain current and former owners of out-of-state motor vehicles (cars, trucks, etc.) are ENTITLED TO REFUNDS.

About 10% of vehicles in California are out-of-state vehicles.

DMV has overcollected about $800 million and has not stopped overcollecting.

You will not receive a refund unless you file a claim for refund.

If you do not file a claim, the DMV may also continue to overcharge you each year.

THE LICENSE FEE DISCRIMINATION.

License Fee is part of the yearly charge for a license tag; it varies roughly with the vehicle's

value & age.

The DMV uses a different, unconstitutional way of computing license fees on many out-of-state vehicles than it uses for fees on California Vehicles.

The overcharges are greatest on collector vehicles, but still significant on many ordinary vehicles.

ELIGIBILITY FOR A LICENSE FEE REFUND

Your vehicle (current or former) has to be an out-of-state vehicle. See Below to tell if your

vehicle is an out-of-state vehicle.

Your vehicle has to be a 1991 or older model year vehicle.

You had to have bought the vehicle before August 1, 1991, or received it from your parent,

child, grandparent, grandchild, husband or wife, or a string of them, the first of which bought

it before then.

You do not have to be the person who bought your vehicle out-of-state; a prior owner could

have bought it out-of-state.

Refunds Are Available for All Motor Vehicles, Not Just Passenger Cars.

HOW TO TELL IF A VEHICLE IS AN OUT-OF-STATE VEHICLE.

The best clue that your vehicle is an out-of-state vehicle is the "type vehicle" code that

appears on some DMV documents (registrations, pink slips, etc.). "Type vehicle" codes

the first two characters of which are 13, 16, 17, 23, 26, 33, 37, 43 and 47 are out-of-state

vehicles. However, not all out-of-state vehicles have out-of-state Type Vehicle Codes.

There are several other clues that a vehicle came from out of state.

The presence of an "asterisk year" on the vehicle's title or registration less than "91." It is

often abbreviated "* yr" and usually appears in an open-topped red box on some titles, and

appears on registration receipts.

If the manufacturer's emission control certification under the hood of post-1973

automobiles does not mention "California," then the vehicle is probably from out of state.

The size of the VLF that you are paying may be a clue. If your VLF is considerably larger

than other people's vehicles of the same age and original value, you may have, or used to

have, an out-of-state vehicle.
